Atlanta residents, beware of deceptive debt collection tactics

When Georgia residents are being harassed in any way by debt collectors, it is time to seek legal counsel from a reputable attorney. Many of the tactics that debt collectors use to try to collect debts are illegal. Debt collectors do not have the right to call people repeatedly, to use threatening or abusive language, or to lie about how much a person owes.

Horror stories involving outrageous debt collection practices

Many Georgia residents can relate to having been harassed by a bill collector at one time or another. Although there are numerous protections under the Fair Debt Collection Practices Act as well as state laws that specifically prohibit abusive and threatening behavior by debt collectors, many of them still employ these tactics when attempting to collect on a debt. Some of the tactics include threats of violence, using obscenities, incessant telephone calls and claims by the caller that he or she is an attorney.

Student loan collectors threaten debtors with wage garnishment

Debt collector sued for threatening wage garnishment

Under the federal Fair debt Collection Practices Act, creditors and debt collectors may not use abusive debt collection practices. This means that companies and individuals may not intimidate, threaten, harass, or lie to a debtor when they are attempting to collect on a debt. According to the Federal Trade Commission, the number of consumer complaints about improper debt collection practices increased by more than 15 percent in 2010, likely due to the struggling economy.

New agency will crack down on debt collectors

Being in debt is stressful. Not only is there the impending threat of repossession, foreclosure, and ruined credit, but debtors also have to deal with the constant telephone calls from creditors and collection agencies. Many debtors simply stop answering their phones or opening their mail, scared of what will be on the other end. And when the calls and letters get to be too much, debtors seek relief through bankruptcy or a similar measure.
