Bankruptcy and Judgments
Helping Clients Stop Lawsuits, Judgments, Garnishments and Liens
If an individual or business has sued you on a debt, you could be facing bank account and wage garnishment and other legal problems. A bankruptcy lawyer will help you stop the threat of these legal consequences by getting your debts wiped out in Chapter 7 or Chapter 13 bankruptcy.
At Gingold & Gingold LLC, we offer clients the assistance of two experienced attorneys: Ira D. Gingold, who has been a bankruptcy lawyer since 1971 and Court-appointed Bankruptcy Trustee from 1971-2013, and Jamie L. Gingold, who has been practicing bankruptcy, real estate and business law since 2001. We are committed to helping our clients stop lawsuits and wipe out their debts.
Understanding How Bankruptcy Puts a Stop to Debt Collection
If you have fallen behind on repaying a debt — such as a credit card balance, medical bill, bank loan or finance company loan — your creditor can sue you and get a judgment against you. This judgment allows the creditor to take a number of different debt collection measures.
Once a bank or other creditor has a judgment against you, it can file garnishments on your paychecks and bank accounts, taking your money until the debt is repaid in full.
A creditor with a judgment can also send the sheriff to your home to levy on (take) your personal property and may even be able to foreclose and sell your home to repay the debt.
The good news is that the moment you file bankruptcy, all lawsuits against you and garnishments of your wages and bank accounts must stop, and if the debt can be discharged (wiped out) in bankruptcy, your attorney will file motions to remove any judgment liens from your property.
